10th Amendment

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

  1. So in other words if they don't mention it in the constitution the Federal Government should stay the heck out of it.

  2. Absolutely. Unfortunately, our state legislatures have lost their backbone when it comes to challenging the overreach of Federal Government. It is the duty of the States to protect their citizens from such Federal tyrany. This was a hot issue under Madison and Jefferson (see Kentucky and Virginia Resolutions) during passage of the Alien and Sedition Acts under Adams. The state legislatures lost much power with the passage of the 17th Amendment, which should be repealed.
